1. Acceptance and Binding Agreement

These Terms & Conditions (“Terms”) form a legally binding agreement between Entree Media Pte Ltd (“Entree Media”, “EM”, “we”, “us”, “our”) and the person or entity placing an order (“Customer”, “you”, “your”).

By:
• creating an account,
• placing an order,
• clicking “I agree”,
• signing any collection or delivery form, or
• collecting, receiving, or using the Equipment,
you agree to be bound by these Terms.

Where you act on behalf of a company or organisation, you confirm you have authority to bind that entity.

Entree Media may update these Terms from time to time.
The version in force at the time of order applies unless otherwise agreed in writing.

2. Definitions

Equipment – All rental items supplied, including accessories, batteries, cables, media, cases, and bundled items.
Rental Period – Period stated in order confirmation including any approved early collection or late return allowance.
1-Day Rate – Standard undiscounted daily rental rate for the Equipment.
Replacement Value – New replacement or replacement procurement cost including shipping, taxes, duties, and reasonable procurement costs, determined by EM acting reasonably.
Return Complete – When Equipment has been returned, inspected, and accepted by EM. 

3. Orders, Availability and Right to Refuse

All rentals are subject to availability and confirmation.
Entree Media may cancel, decline, or modify orders if we reasonably believe there is risk of:
• non-payment
• fraud or misrepresentation
• unsafe or unlawful use
• non-return risk
• operational limitations

4. Payment Terms

Unless otherwise agreed in writing:
Full payment must be received before Equipment is released.
Entree Media may require deposits, pre-authorisations, or additional verification at our discretion.

5. Authorisation to Charge Payment Method

Customer authorises Entree Media to charge any payment method provided for:
• Rental fees
• Late return charges
• Damage repair costs
• Replacement costs
• Missing accessories
• Cleaning or restoration
• Downtime / Out-of-Service charges
• Delivery, recovery or enforcement costs

Where reasonably practicable, EM will attempt to notify Customer before charging.
If Customer does not respond within 48 hours, or where EM reasonably believes there is risk of asset loss, fraud, disappearance, or non-payment, EM may charge without further notice.
Customer remains liable for unpaid balances if payment fails.

6. Operating Hours and Access Arrangements

Standard operating hours are typically 0800 hrs to 1700 hrs, Monday to Friday (excluding public holidays), unless otherwise notified.

Where in-person handover is unavailable, EM may provide secure alternatives including:
• QR code access
• Secure locker access
• Designated drop-off points
• After-hours collection arrangements

Once access credentials are issued, Equipment is deemed made available and Customer assumes responsibility.
Access logs and CCTV may be used for verification.

7. Collection, Return and Delivery

Self Collection / Return
Collection may be available afternoon before rental start.
Return is typically morning after rental end unless otherwise stated.

Delivery and Collection Fees
Singapore mainland: SGD 50 per trip
Additional surcharges may apply:
• Jurong Island: + SGD 80
• Tuas / Loyang / Changi: + SGD 25

8. Equipment Condition and Use

Customer acknowledges Equipment is supplied in working condition unless noted otherwise.
Customer must:
• Use Equipment properly and lawfully
• Protect from loss or damage
• Not modify or repair Equipment
• Not sub-rent without approval
• Not tamper with tracking or security devices

9. Late Returns and Unreturned Equipment

Late returns are charged at the full 1-Day Rate per day or part thereof.
If Equipment is not returned within 24 hours and EM cannot contact Customer, EM may initiate recovery or police reporting.

After 7 days, Equipment may be deemed stolen and Replacement Value charged.

10. Damage, Loss and Missing Items

Customer bears full risk of damage, loss or theft during Rental Period.
Customer is liable for:
• Repair costs
• Cleaning / restoration
• Missing accessories
• Replacement Value if beyond repair

11. Downtime / Loss of Rental Income

If Equipment becomes non-rentable due to Customer damage or loss:
EM may charge Out-of-Service fees based on 1-Day Rate for reasonable downtime.
Where EM can demonstrate impacted bookings, actual loss may be claimed.
EM may waive or reduce at discretion.

12. Tracking, Telemetry and Security Measures

Customer acknowledges EM may install or use tracking, telemetry, or monitoring technology including location or usage data for asset protection and recovery.
Tracking may be active or inactive and may not be disclosed.
Customer must not tamper with such systems.
EM may share tracking data with law enforcement, insurers, or recovery agents if required.

13. Data Ownership and Media Wipe Consent

Customer retains ownership of creative content created using Equipment.

If recording media is returned to EM:
Customer agrees media may be wiped or formatted without liability.
Customer is responsible for backups.

14. Pricing and Discounts

Multi-day pricing or promotions may change without notice.

Late return charges always based on standard 1-Day Rate.

15. Insurance

Customer is encouraged to obtain insurance.

Regardless of insurance, Customer remains fully liable to EM.

16. Limitation of Liability

EM is not liable for indirect or consequential losses including:
• Production losses
• Revenue loss
• Third-party claims

Total EM liability is limited to rental fees paid for affected Equipment.

17. Indemnity

Customer indemnifies EM against claims arising from Equipment use, except where caused solely by EM negligence.

18. Ownership

All Equipment remains EM property.

Customer must prevent liens, seizure, or third-party claims.

19. Recovery and Enforcement

EM may:
• Refuse future rentals
• Use recovery agents
• Commence legal proceedings
• Report to authorities

Recovery costs may be charged to Customer.

20. Personal Data (PDPA)

EM may collect and use personal data for:
• Rental processing
• Verification
• Asset protection
• Fraud prevention
• Operational communication

Customer consents to contact via email, phone, or messaging.

21. Governing Law

These Terms are governed by Singapore law.
Disputes fall under exclusive jurisdiction of Singapore courts.

22. Miscellaneous

These Terms form entire agreement.
Invalid clauses do not affect remaining Terms.
No waiver unless in writing.
Multiple Customers are jointly liable.

Optional Security Clause

EM may require deposits or security arrangements at discretion.
